Please understand that all services provided by Personal Comfort through this website, including the sale of any products, are provided subject to the following terms and conditions. BY USING THIS WEBSITE, WHETHER BY PURCHASING ANY PRODUCTS FROM OUR WEBSITE, PURCHASING PRODUCTS OVER THE PHONE, OR BY DOWNLOADING ANY INFORMATION OR MATERIALS FROM THE SITE OR OTHERWISE, YOU INDICATE YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS AND AGREE THAT YOU WILL BE BOUND BY AND SUBJECT TO THESE TERMS AND CONDITIONS. Product Sales and Orders

All mattress orders include free shipping. Some assembly is required. White Glove Delivery is available per request for adjustable bed base products only.

There will be a 6.5% state sales tax applied to orders shipped to the state of Florida. There will be no sales tax collected for all other out of state deliveries.

If you choose to pay with a credit card it will be charged at time of order unless order is pending payment. Personal Comfort is not responsible for any error created by you if you decide to place an order online without the assistance of a Sleep Specialist. Any and all errors will be researched and resolved as they occur. Personal Comfort is not responsible for any delays related to order deliveries caused by weather conditions or related issues. Personal Comfort is not held responsible for any issues regarding slight color variations of the delivered items and online pictures. If for any reason, you decide to cancel their order, you must notify Personal Comfort, within 24 hours from the Time and Date of Purchase. Example: The order is placed on Jan 1st, 2015 at 2:00 PM Eastern. You have the right to cancel your order until Jan 2nd, 2015 at 2:00 PM Eastern. If you cancel your order after 24 hours and the order has not yet shipped, you will be entitled to a refund minus a 25% restocking fee. If you cancel your order after 24 hours and the order has already shipped, you will be entitled to a refund minus a 25% restocking fee and all shipping fees associated with your order.

Promotions and Offers

Price adjustments to special promotions and offers that include but are not limited to promo codes, sale end dates, financing promotions, closeout sales, etc. may only be honored within 7 calendar days from date order is placed.

Financing

You agree to the order you placed through www.personalcomfortbed.com and/or over the phone when selecting "financing" as your method of payment. Your sale price and financing terms are agreed to prior to placing your order either through our website and/or over the phone. If you have concerns prior to placing a financing order, we ask that you do not place an order until you absolutely understand and consent to our financing terms and sale price.

Once your order is placed you agree to the sale price as well as the financing option selected when placing your order. Your requested financing option will be added to your order at the time the order is placed, this is to avoid confusion with your order's sale price and financing offer. Promotional offers cannot be combined, the sale price offered is a cash only promotion where-as the financing price is a separate promotion.

If your financing is approved, your order will be confirmed and awaiting fulfillment, just as long as your information, proof of identification and financing application approval match up. Any special offers and/or promotions will be defined when the order is placed and are subject to the terms and conditions of this website. These terms will be on your original invoice that you will receive at the time your order is placed. We will not and do not "change" any terms when, and after, an order is placed either through our website and/or over the phone, the terms of your order are unchangeable once your order is placed, unless approved and authorized by a manager. By completing the application for financing, you are agreeing to all financing terms, sales prices, regards to your original order and the terms and conditions listed on the www.personalcomfortbed.com website.

Delivery

All mattresses will be shipped within agreed upon terms. All details of delivery must be added to the order. We strongly urge you to inspect your delivery upon receipt. Personal Comfort is not responsible for any shipping damage or issues with the purchased product. In the rare event your order is damaged due to shipping we will follow standard procedures for filing a claim with the delivery company, order delivery research and determine an appropriate resolution for all parties.

If your order includes an adjustable bed base, your order will be shipped standard freight truck. It will take between 3-4 weeks to be delivered. If you order White Glove services there will be an additional 3 to 5 business days for delivery and setup of your order.

Shipping

Tracking information will be made available to you upon shipment of your order. You will be emailed your tracking numbers within a few days after your order has shipped. You can also log into your account and view tracking information. A $200 handling fee is added to order shipments delivered to Hawaii & Alaska to cover the increased cost of shipping. There may be additional charges due to the size and weight of your order if you reside in Hawaii or Alaska. Shipping of adjustable bed bases to Hawaii & Alaska require special rates, please contact us to get a quote.  *If you live in the 48 states and you purchase an adjustable bed, it will be shipped standard freight truck. It will take between 3-4 weeks to be delivered. If you order White Glove services there will be an additional 3 to 5 days for delivery and setup of your adjustable bed base.

*Fast Free Shipping applies to all orders. If your order was placed over the weekend it will be setup for shipping on Monday. Please allow 3-5 days for tracking numbers to become available for most common sized mattresses. Most common sized mattress shipments will arrive between 7 to 10 business days. If you order included a FlexHead mattress, adjustable bed base and/or White Glove services your order will take between 3-4 weeks to be delivered. During peak season and over holidays please expect a short delay with shipment due to seasonal influx. Thank you for your patience.

**HI and AK Shipping There will be an additional shipping fee for orders shipping to HI and AK. These fees will vary depending on the product whether it is an accessory item or a bed set. A $200 handling fee is added to orders shipped to Hawaii & Alaska. Shipping orders to Hawaii or Alaska require special rates, please contact us to get a quote.

Damaged Freight Delivery Shipments

If you think that your product has been damaged during shipment you must open the boxes and fully inspect the product before you accept delivery. Any signs of damage must be fully documented, we recommend taking photos if you can during the delivery process if there is any damage to your order.

Note: Bulging and discoloration of boxes is normal wear and tear from shipping your order across the country.

If there are puncture holes, rips, tears or signs that a box has been opened you must fully inspect the product for any possible damage. It is completely OK to have the freight company wait for you to inspect the product. If there is any damage, you must have the freight company document the damage. If there is any damage, you (or the freight company) must take a photograph of the damage. Photographs of the damage are required in order to process your claim for a free product replacement. After you have documented the damage please call our Service Department 1-888-694-4088 immediately we are open Monday through Friday from 9:00 AM to 5:30 PM Eastern and Saturdays from 11:00 AM to 5:00 PM Eastern if we are not available please email us at support@personalcomfortbed.com be sure to include your order number within the subject line. We will then communicate directly with the freight company to arrange to have the product removed from your home and replaced.  

Note: If your order is a multi-box shipment you can sign for the product that is not damaged and we can file a claim for the product that is damaged.  If you did in-fact receive damaged product(s) from shipping, you must allow us to replace and reship the product. There will be no additional charges to you if your product was damaged during delivery and you followed the above instructions.

If there is no damage to your product and you still choose to refuse your order without notifying us first and/or taking photographs to document the damage you will incur freight charges both ways plus 25% product restocking fee. Your refund will not process until the product(s) have been received back to our warehouse and properly inspected. This process is estimated between 45-60 days.

Cancelled Orders

If for any reason, you decide to cancel their order, you must notify Personal Comfort, within 24 hours from the Time and Date of Purchase. Example: The order is placed on Jan 1st, 2015 at 2:00 PM Eastern. You have the right to cancel your order until Jan 2nd, 2015 at 2:00 PM Eastern.

If you cancel your order after 24 hours and the order has not yet shipped, you will be entitled to a refund minus a 25% restocking fee. If you cancel your order after 24 hours and the order has already shipped, you will be entitled to a refund minus a 25% restocking fee and all shipping fees associated with your order.

Mattress and Accessory orders are confirmed by us within 24 hours of when your order was placed, if you wish to cancel, please email info@personalcomfortbed.com or call 888-694-4088. If you cancel your order after the 24 hour time frame, your order will be subject to the 25% cancellation fee.

If you choose same day shipping, and you want to cancel your order, you will be required to pay a 25% cancellation fee. Same day shipping takes place immediately after your order is placed.

Refused Shipments

If you choose to refuse the shipment of any or all of your products including but not limited to mattress, bases, adjustable bed bases and accessories you will incur freight charges both ways and a 25% restocking fee will apply to your order. Refund minus freight charges both ways and 25% restocking fee will be issued within 30-45 days after date of order placed.

120 Night Risk Free Trial Terms

What is your 120 night risk free trial?

At Personal Comfort we believe a full 120 nights is needed for your body to adjust to its new sleep support system. Please contact us if during any part of the 120 night risk free trial you are not completely satisfied with the overall comfort. You must sleep on the bed for at least 45 nights to qualify. Personal Comfort will honor our 120 night comfort exchange policy. We will do our best to supply you with the best night sleep you can receive. On rare occasions, sometimes the air chambers functionality isn’t enough, our comfort exchange policy allows for you to exchange components of your mattress to help accommodate for a more plush or firm feeling. We will even exchange your recently purchased mattress for one of equal value. Your trial date starts on the date you receive your mattress.

120 NIGHT RISK FREE TRIAL AVAILABLE ON ADVANCED, ELEGANCE AND MEMORY FOAM SERIES MATTRESSES ONLY, YOU MUST SLEEP ON MATTRESS FOR 45 NIGHTS TO QUALIFY.

ACCESSORIES, FOUNDATIONS, ADJUSTABLE BED BASES, METAL BED FRAMES, SPACE SAVER BED BASES, BRACKETS, CHILI PADS and BEDDING (SHEETS, PROTECTORS, PADS, ETC.) ARE NOT RETURNABLE. PUMPS, AIR CHAMBERS, HOSES, CONNECTORS PURCHASED AS REPLACEMENT PARTS FOR COMPETITORS BEDS ARE FULLY WARRANTIED AND DO NOT QUALIFY FOR 120 NIGHT RISK FREE TRIAL TERMS.

If during your first 45 nights your pump isn’t functioning properly, the remotes are not reading numbers correctly, you feel sagging or any other defective issues with the product not working properly please call us to let us know. Any defective component that is replaced under our 25 year warranty your 120 night risk free trial will be extended and reset to the date you received the replacement components.

You must keep the product for 45 days before any return can be issued or approved. An RMA must be filled out, and signed, prior to the end of your trial period (days 46-120). Failure to send us a filled out and signed RMA may result in a forfeit of your ability to return your mattress. Once your product is picked up from your location it may take up to two weeks for our warehouse to receive the product. It may take up to 15 days for Personal Comfort inspect the product for any wear and tear or damages that may have occurred during your possession of the product. Once the product is inspected it may take up to an additional 30 days for you credit to be applied to your credit card, financing, or by check. Credits or charges due will be issued to the original form of payment. If you are still in a hurry to return, all returns processed before day 45 of sleep trial will result in a mandatory 25% restocking fee. Total estimated time to receive refund 30-45 days, from date RMA is approved.

All beds and components must be returned in like-new condition. This means absolutely no hair, blemishes, holes, stains, odors (such as cigarettes and cigar), scratches (on the remote control face and/or pump encasement) to qualify for a full refund or exchange. If any of the components appear damaged you will be responsible for the retail cost of replacement for each component that is damaged, for every damaged component we will keep evidence on your purchase order. Adjustable frames, bedding, pillows and accessories are not included within the 120 night risk free trial. *Orders cancelled or refused after shipping will be credited a refund minus the freight cost to ship both ways and a 25% restocking fee.

There are no return shipping fees for mattresses included in our 120 Night Risk Free Trial. You must use product for the first 45 days. We recommend that you keep your original boxes in the event you wish to return your mattress. If you need to purchase boxes from Personal Comfort you will be responsible for box costs and shipping to your address, shipping rates will vary, please call for a quote. In order to ship back your mattress you must disassemble your mattress and ship back in multiple boxes, depending on the size of your mattress. Twin, Twin XL, Full and Double sized mattress can be shipped back with a maximum of three boxes. Queen, King, California King, Flex-Head King, Flex-Head California King sized mattresses can be shipped back with a maximum of four boxes. Split King and Split California King sized mattresses can be shipped with a maximum of five boxes. If you ship back more than allowed number of boxes you will be required to pay additional shipping fees for the additional boxes, these fees will be subtracted from your total eligible refund. All returns processed before day 45 of sleep trial will result in a mandatory 25% restocking fee.

120 Night Risk Free Trial vs. 120 Night Trial

120 Night Risk Free Trial: Personal Comfort is responsible to pay shipping costs to and from your shipment location during the 120 night risk free trial period. You must use the mattress for a minimum of 45 nights. You must allow us to ship out any defective components caused by damage during shipping during the first 45 nights to qualify. Your trial will automatically reset and extend for another 120 nights after you receive replacement parts for any item damaged during shipment. If the mattress you purchased qualifies for this trial, and is returned without any damage during this trial period, and passes inspection as "like-new" condition, then a full refund for the mattress will be credited (trial available on mattress only). Your trial date starts on the date you receive your mattress.

120 Night Trial: Personal Comfort will take back qualifying mattresses during the 120 night trial period. You must use the mattress for a minimum of 45 nights. You must allow us to ship out any defective components caused by damage during shipping during the first 45 nights to qualify. Your trial will automatically reset and extend for another 120 nights after you receive replacement parts for any item damaged during shipment. If the mattress you purchased qualifies for this trial, and is returned without any damage during this trial period, and passes inspection as "like-new" condition, then a refund minus a restocking fee of $149 will be credited (trial available on mattress only). Your trial date starts on the date you receive your mattress.

What is Personal Comfort's return policy?

After forty five (45) nights from receipt of delivery you will have the option to exchange your mattress or return it for a full refund*. You will have an additional 75 days (for a total of 120 days from your purchase date) to schedule a return.  *Classic series models have a $149 restocking fee if returned within days 46-120 from arrival. Online Edition, Adjustable Bed Bases, Accessories, Chili Pads, Chili Gels, Demo and Showroom Floor Models are Non-Returnable. Returns are not accepted after 120 days from arrival. Orders cancelled or refused after shipping will be credited a refund minus the freight cost to ship both ways and a 25% restocking fee.

Mattress returns must be disassembled, wrapped in plastic and packaged with care into multiple boxes. We recommend that you keep your original boxes in the event you wish to return your mattress. If you need to purchase boxes from Personal Comfort you will be responsible for box costs and shipping to your address, shipping rates will vary, please call for a quote. In order to ship back your mattress you must disassemble your mattress and ship back in multiple boxes, depending on the size of your mattress. Twin, Twin XL, Full and Double sized mattress can be shipped back with a maximum of three boxes. Queen, King, California King, Flex-Head King, Flex-Head California King sized mattresses can be shipped back with a maximum of four boxes. Split King and Split California King sized mattresses can be shipped with a maximum of five boxes. If you ship back more than allowed number of boxes you will be required to pay additional shipping fees for the additional boxes, these fees will be subtracted from your total eligible refund.Mattress must be in excellent “like new” condition; no hair, blemishes, holes, stains, odors (such as cigarettes and cigar), scratches (on the remote control face and/or pump encasement) to qualify for a full refund or exchange. If your mattress is sent back in poor condition, contains hair, shows stains, has odors including cigarette and cigar smoke, pet fur, scratches on remotes, scratches or damage to the pump or any other damage then you will be responsible for the retail cost of replacement for each component that is damaged, for every damaged component we will keep photographic evidence on your purchase order.

In the unlikely event you receive incorrect or damaged merchandise, please notify us immediately. We will correct this ASAP. You must allow us to ship out any incorrect and/or defective components caused by damage during shipping during the first 45 nights to qualify for your trial. Your trial will automatically reset after you receive replacement parts for any item damaged during shipment. Any defective component that is replaced under our 25 year warranty your 120 night risk free trial will be extended and reset to the date you received the replacement components.

If you did receive a defective component and had it replaced you will need to make sure to return the defective component to remain eligible for the 120 night trial. By not returning defective items when given a call tag for them you will void your eligibility in your 120 night trial. For any unreturned part you will be charged the retail priced value. For any returned part that has been received please allow up to 30 days for any refund to post to your account, if applicable.

Mattresses with a cut tag, or cut tags, is/are non-returnable. If you attempt to return your mattress and during inspection we discover there is a cut tag you will forfeit your refund.

To begin the return process please contact our Returns Department 888-694-4088 (ext. 6) to request a RMA (Return Merchandise Authorization) form. Our Returns Department is open on Monday through Friday 11:00 AM - 4:00 PM Eastern, our Returns Department is CLOSED on Saturday and Sunday. One of our Returns Specialists will ask you some basic questions regarding your request for a return. Once you have answered all the questions we will then be able to pre-qualify you for an RMA. Your RMA will be emailed directly to you. You will be required to complete, sign, and fax back the RMA form to 302-241-0125. Your RMA form will require management approval, after approval you will receive the approved RMA via email. You will need to insert the approved RMA with your product. YOU MUST INCLUDE APPROVED RMA FORM WITH YOUR RETURN OR YOU WILL VOID YOUR RETURN ELIGIBILITY.  If you have any questions, please call 888-694-4088 (ext. 6) during our Returns Department hours of operations written above. The ability to return a mattress for full credit is voided if trial period has expired or if return is not picked up within 7 (seven) days of pickup scheduled date.
